Terms of Service
EFFECTIVE OCTOBER 25, 2026
These terms are an agreement between you and NOVA HQ ("we", "us") for the use of thenovahq.com and the NOVA HQ dashboard and AI agents (the "Service"). By creating an account or using the Service you agree to them. If you use the Service for an agency or team, you agree for that agency too.
1. What the Service does
NOVA HQ gives life insurance agents and their uplines software agents that help run the back office: texting and booking leads (S.A.R.A.), finding deals to call back (D.R.E.W.), payment and retention follow-up with clients (M.A.G.), live call help and CRM notes (L.E.O.), sales practice (S.P.A.R.) and reports (N.O.V.A.). The Service works inside tools you connect, such as your CRM.
2. Who can use it
You must be at least 18 and, where you sell insurance, hold the licenses your state requires. You are responsible for your login. Keep your password private and tell us right away if you think someone else used your account.
3. Your responsibilities for texts, calls and emails
The Service sends messages and handles calls on your behalf, from your own CRM and phone numbers. You are the sender. You agree that:
- You have the consent the law requires before anyone is texted, called or emailed through the Service, including under the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, state telemarketing laws and carrier rules for business texting (10DLC/A2P).
- You honor opt-outs and do-not-call requests. The Service stops texting anyone who replies STOP, and you must not restart messages to them.
- You follow call-recording and monitoring laws in your state and your caller's state. Some states require everyone on a call to agree before it is listened to; when that applies, you tell the caller before using L.E.O. on the call.
- You follow insurance advertising and marketing rules from your state and your carriers, and you review what the Service sends in your name.
The Service only sends texts on weekdays and Saturdays in daytime hours in the lead's time zone, and it keeps a record of opt-outs. These are tools to help you comply, not a guarantee that you do.
4. AI output
The agents use artificial intelligence. Their suggestions, notes, scores and messages can be wrong or incomplete. They are not legal, compliance, tax or insurance advice. You decide what to say to clients and what goes in your CRM and carrier applications. Example stories in client emails are labeled as examples and are not real clients.
5. Your data
You own your data and your leads' and clients' data. You give us permission to process it only to run the Service for you, as described in our Privacy Policy. If you are on an upline's team, your upline sees your totals (such as appointments, sales, premium at risk and practice hours), never your leads' or clients' names or numbers.
6. Plans, payments and cancellation
- Plans are billed monthly in advance at the price shown on thenovahq.com when you subscribe. Plans are month to month. You can cancel any time and keep access until the end of the month you paid for. We don't give refunds for partial months.
- S.P.A.R. practice hours: each account gets its monthly allowance, which resets on the 1st and does not carry over. Hours you buy in packs never expire.
- Handwritten cards are bought as credits. A card that has been sent to be written and mailed can't be refunded.
- You pay any costs from tools you connect yourself, such as your CRM, phone numbers and text messages.
- We may change prices with at least 30 days' notice. The new price applies from your next billing month.
7. Acceptable use
Don't use the Service to send spam, to message people who haven't agreed to hear from you, to mislead anyone, to break the law, or to try to access other accounts or our systems. Don't copy, resell or reverse engineer the Service. We may suspend an account that puts others at risk, and we'll tell you why.
8. Availability and changes
We work to keep the Service running, but it may sometimes be down for maintenance or because of problems with tools it depends on. We may improve or change features. If we remove something you pay for, we'll tell you first.
9. Limits on liability
The Service is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, such as lost sales, lost commissions, chargebacks or fines from messages you sent, and our total liability for any claim is limited to what you paid us in the 3 months before it. You agree to cover claims against us that come from messages or calls you made through the Service in breach of these terms.
10. Ending the agreement
You can close your account any time. We can close it with 30 days' notice, or right away for a serious breach of these terms. After closing, you can ask for a copy of your data within 30 days; after that we delete it.
11. Law and changes to these terms
These terms are governed by the laws of the State of Florida. If we change them in a way that matters, we'll tell you by email or in the dashboard at least 14 days before the change applies.
